JJLM defeats the United States Government’s Motion to Dismiss Isidro Andrade-Tafolla’s case.

Oregonians should be free from racial profiling and unconstitutional seizures. Mr. Andrade-Tafolla, a Washington county resident and U.S. citizen, was illegally detained by ICE agents after leaving the Washington County Courthouse. With the help of Johnson Johnson Lucas & Middleton and ACLU of Oregon, Mr. Andrade-Tafolla has sued the federal government for violating his rights. Last week the Oregon District Court denied the government’s Motion to Dismiss Mr. Andrade-Tafolla’s case, finding that the ICE agents’ conduct of racially profiling Mr. Andrade-Tafolla and stopping him without reasonable suspicion that he had committed a crime was not protected under the discretionary immunity doctrine.
